Fav Spot Business Contest Rules

  • How to Enter: No purchase necessary. Limited one entry per business establishment entrant. To enter the Fav Spot Business Contest (the “Contest”), entrants must, between 12:00 a.m. ET on March 1, 2021 and 11:59 p.m. on March 14, 2021 (the “Contest Period”): (i) follow the official Tourism Vaughan Corporation Facebook (Visit Vaughan) and/or Instagram (@VisitVaughan) accounts, and (ii) receive the largest quantity of Unique Votes within the business’s applicable category, all in accordance with these Contest Rules.

 

Contest Entry via Category Voting

  • Categories: There are a total of six (6) categories, in which a qualifying business establishment must be applicable to at least one (1). The categories are as follows: (i) hotels; (ii) restaurants; (iii) attractions; (iv) gardens, parks and trails; (v) museums and galleries; (vi) theatre, entertainment and events; and (vii) public libraries (“Categories”). If a business establishment qualifies for more than one category, the business establishment must select which category to remain in, while all other applicable categories will be disqualified. Business establishments that do not apply to any of the listed categories do not qualify. Final determination of whether a business establishment qualifies for any of the listed categories remains with Tourism Vaughan and is irrevocable.
  • Voting: A Vote is determined as one (1) Qualifying Online Entry Facebook and/or Instagram post in which the business establishment has been directly tagged by mention (@) or by hashtag (#). A Qualifying Online Entry requires the following: (i) the Fav Spot Vaughan contest entrant must follow the official Tourism Vaughan Corporation Facebook page (Visit Vaughan), and/or Instagram account (@VisitVaughan); (ii) post a publicly accessible photo and/or video with a comment concerning their favourite spot in Vaughan using the hashtag #favspotvaughan and/or #BrighterDaysAhead; (iii) be submitted by an individual that has reached the age of majority and who lives or works in the city of Vaughan; and (iv) be received by Tourism Vaughan Corporation during the Contest Period (“Qualifying Online Entry”). A business establishment must be directly tagged by mention (@) or by hashtag (#) on the Qualifying Online Entry to receive one (1) vote. For the vote to qualify, it must: (i) come from a Qualifying Online Entry; and (ii) not be a repost or a shared post done once more by the original poster (“Unique Vote”). Facebook and/or Instagram posts made by the business establishment’s own social media channels will be automatically disqualified and will not count towards the final Qualified Online Entries or Unique Votes.
  • Category Voting: At the conclusion of the Contest Period, Unique Votes will be tallied on all Qualifying Online Entries for each category. The business establishment that has the largest number of Unique Votes within its applicable category will win a Prize. Each business establishment can only win a maximum of one (1) Prize.
  • Eligibility: In order to be eligible to win a Prize, qualifying business establishments (“Qualifying Business Establishments”) must: (i) be located with a legal business address within the city of Vaughan; (ii) qualify in one (1) of the listed categories applicable to the Contest as per the determination of Tourism Vaughan Corporation; (iii) have received Unique Votes from Qualifying Online Entries during the Contest Period; and (iv) have received the largest number of Unique Votes within its applicable category, compared to other Qualifying Business Establishments within the same category. Online Entries and business establishments that do not satisfy all Contest Rules will be disqualified.
  • Proof of Receipt: The sole determinant of time for the purposes of receipt of a Qualifying Online Entry will be the computer servers of Tourism Vaughan Corporation. Proof of mailing or transmission (screenshots or captures, etc.) does not constitute proof of receipt.
  • Identity of Entrant: All submissions will be deemed to have been made by the legal owner of a Qualifying Business Establishment, regardless of the identity of the party submitting on behalf of that business. Potential winners may be requested to provide Tourism Vaughan Corporation with proof that the potential winner is the legal business owner of the Qualifying Business Establishment associated with the winning tally of Unique Votes within its category.
  • Content Restrictions: In addition to any other restrictions set out in these Contest Rules, Online Entries must not: (i) contain material that violates, misappropriates, or infringes upon any law or regulation or the rights of any third party, including any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or proprietary rights; (ii) disparage any person or entity; (iii) contain material that is inappropriate, indecent, obscene hateful, tortious, and/or defamatory; (iv) contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; (v) contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where an Online Entry is created; or (vi) identify or promote private commercial, company or business names of the entrant or other private individual, or services offered by such parties, as a means of advertising same.
  • No Facebook, Twitter, or Instagram Endorsement: This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, or Instagram. Any information that you provide in connection with the Contest is to Tourism Vaughan Corporation and not to Facebook, Twitter, or Instagram. Entrants understand that by using and interacting with Facebook, Twitter, or Instagram, entrants are subject to the terms, conditions and policies that govern the use of such social media outlets. Entrants should therefore review the applicable terms and policies for Facebook, Twitter, or Instagram, including privacy and data gathering practices, before using or interacting with Facebook, Twitter, or Instagram.
  • Display: Tourism Vaughan Corporation may display all Qualifying Online Entries on Tourism Vaughan Corporation’s Facebook and/or Instagram page and/or website. By uploading Qualifying Online Entries, entrants agree that they conform to these Contest Rules and the applicable terms and policies for Facebook, Twitter, and/or Instagram. By uploading a Qualifying Online Entry, entrants: (i) represent and warrant that it does not and will not violate, misappropriate, or infringe upon any law or regulation or the rights of any third party, including any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or proprietary rights; (ii) represent and warrant that they have permission from all individuals (including parents/legal guardians of children, if featured and not entrant’s own) that appear in the Qualifying Online Entry to use their name and image in the Qualifying Online Entry; and (iii) acknowledge that Tourism Vaughan Corporation has the irrevocable right to incorporate Qualifying Online Entries, in whole or in part, into other works, in any form, media or technology now known or hereafter developed.
  • Conduct: By participating in the Contest, entrants acknowledge that entrants have read and understood these Contest Rules and agree to abide and be bound by them and all decisions of the City, which shall be final and binding, without right of appeal, in all matters relating to this Contest and the awarding of the Online Prizes. Tourism Vaughan Corporation reserves the right, in its sole and absolute discretion, to disqualify any entrant that it finds to be: (i) in violation of these Contest Rules; (ii) tampering or attempting to tamper with the entry process or the operation of the Contest; (iii) acting in an unsportsmanlike or disruptive manner; or (iv) attempting to undermine the legitimate operation of the Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, THE CITY RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTESTS.

  • Fav Spot Business Prizes: There are six (6) prizes available to be won in connection with the Fav Spot Business submission portion of this Contest (the “Fav Spot Business Prizes”). Each Fav Spot Business Prize is not refundable, not transferrable, not convertible to cash, and subject to availability. Tourism Vaughan Corporation may elect to substitute a prize if the Visit Vaughan Prize cannot be awarded as described for any reason. An entrant cannot win multiple Fav Spot Business Prizes regardless of Contest Entry. Prizes are listed as:

Selection of the Category Contest Winner

  • Selection of Category Contest Winner: At the conclusion of the Contest Period, Unique Votes will be tallied on all Qualifying Online Entries for each category. The business establishment that has the largest number of Unique Votes within its applicable category will win a Prize. Each business establishment can only win a maximum of one (1) Prize. The winning business establishment in each category will be notified by Tourism Vaughan Corporation via Email, Facebook or Instagram direct message during the month of March 2021. Within seven (7) days of Tourism Vaughan Corporation’s notification, the winning business establishment must: (i) claim the Fav Spot Business Prize; (ii) provide identification satisfactory to Tourism Vaughan Corporation evidencing that the winning business establishment is located in Vaughan and, in the case of Qualifying Business Establishments, is the legal owner of the applicable busines establishment; and (iii) correctly answer, without assistance of any kind, a time-limited, mathematical skill-testing question at the discretion of Tourism Vaughan Corporation. If the selected business establishment cannot be confirmed as a winner as above, Tourism Vaughan Corporation may, at its sole and absolute discretion, disqualify the entrant and select another winning entrant, in the same manner as set out herein.

 

General

  • Entrants: By entering this Contest, all business establishment entrants: (i) confirm compliance with (and to be bound by) these Rules; (ii) irrevocably release the City and Tourism Vaughan Corporation, as well as their successors and assigns, officers, employees, members of Council (and Mayor), directors, officers and agents from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims, liabilities, demands or damages (including legal fees and expenses) of any nature or kind, arising out of or in connection with the entrant’s participation or attempted participation in this Contest; and (iii) agree to execute any documentation or do any such other acts as may be required by Tourism Vaughan Corporation to be eligible to collect a Prize if selected as a winning entrant as set out above.
  • Entries: All Online Entries become the property of Tourism Vaughan Corporation.
  • Miscellaneous:
  • This Contest is void where prohibited by law and is subject to all applicable federal, provincial, and municipal laws and regulations.
  • Odds of winning depend on number of Qualifying Online Entries received.
  • Tourism Vaughan Corporation, in its sole and absolute discretion, reserves the right to modify or terminate this Contest and amend these Contest Rules at any time, without individual notice, and for any reason. In no event will more than the stated six (6) total Prizes be awarded.
  • The decisions of the City of Vaughan and Tourism Vaughan Corporation with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Online Entries and/or entrants.
  • ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE TOURISM VAUGHAN CORPORATION AND TOURISM VAUGHAN CORPORATION CORPORATIONAT ANY TIME.
